Your story can be fictitious, based on some of our handouts, or based on a real story from the newspaper.
Your story must show the elements of a crime. It must be clear from the actions of the perpetrator that a crime has been committed. You also must show mens rea on the part of the perpetrator.
You must find an appropriate charge in the Criminal Code of Canada and quote the section number and identify both actus reus and mens rea and match these with the actions of the perpetrator.
As Crown Counsel, you must deelop a theory that has a good chance to convict. You must provide physical evidence that links the perpetrator to the crime and witness evidence to support your theory.
You should include a dialogue of your questioning in court as part odf your direct examination to illustrate the strength of your witness testimony.
Your case needs to have an element of doubt that can be used by the defense to build his or her theory towards acquittal or reduction of the charge.
The defense counsel must develop a theory and questions for one witness to illustrate his theory.
The judge needs to provide a sentence or acuittal and needs to justify his/ her verdict.
As a group, you are required to present your case to the class and take questions to conduct a class disussion on issues that might emerge.
